On his daily podcast, Ben Shapiro notes that many were outraged that ABC had suspended Whoopi Goldberg from The View for two weeks following comments she made about race and the Holocaust.
I agree with most of what you have said, intent indeed does matter. In the case of Dr. Shapiro, not only wasn't there any racist intent, there wasn't any intent to raise racial controversy at all.
He simply wrote a poorly worded tweet, basically misspoke, losing one word in the process. Ilya Shapiro, who is a liberal jurist and a scholar at Georgetown University, argued against President Biden's racialist pledge to appoint black only and only black woman to the retiring Justice Breyer's place. Shapiro supported Indian-American Judge Sri Srinivasan candidacy who is a bit "less black black". Dr. Shapiro just lost one "black" in the process of writing (likely, because of autocorrecting software) and ended up with "lesser black" in his tweet. And the witch hunt has started, with the leftist mobs of modern Hong Wei Bing demanding his head.
ETA: on the other hand, reading Shapiro tweet again, it's possible he might have lost "qualified" ending up with a "lesser black (woman)". In any case, there was no racist intent and he did apologize for his badly worded tweet.

There's usually more than meets the eye in situations like this. Censorship in the media has traditionally been an excellent way to sell books and movies. Rogan is in a position of win-win power because he is essentially Spotify's only star. If they fire him he immediately becomes their biggest competitor instead of their biggest cash cow.
